La Mashine Terms of Use
Revised version of 22 October 2026
This English version is a translation provided for information only. The French version is the only legally binding one.
These terms govern the use of the https://app.lamashine.com/ platform by users invited within a client organization. They also set out the general rules that apply to the provision of the service when they are incorporated into that organization’s contract.
1. Publisher and contact
The platform is published by LA MASHINE, a simplified joint-stock company (société par actions simplifiée) with a share capital of 30,000 euros, registered with the Toulouse Trade and Companies Register under number 932 458 441, whose registered office is at 33 rue du Quatorze Juillet, 31100 Toulouse, France. SIRET: 932 458 441 00015. EU VAT number: FR95932458441. Contact: contact@lamashine.com.
2. Scope and contractual documents
The service is intended for adults using the platform in France at the invitation of a school, a company or another client organization. Self-registration by individuals and access by minors are not covered by this offer.
The “Organization” means the legal entity that has entered into a quote or contract with La Mashine. A “User” is a person authorized to access a workspace. A “Project” brings together the work, content and exchanges of a team. The “Special Conditions” include the quote, the scope of the engagement, the appendices and the amendments accepted by the parties.
The Special Conditions prevail over these Terms in the event of a conflict. The data processing agreement (“DPA”) specifically governs that processing; its accepted specific provisions prevail over its general provisions. Mandatory rules remain applicable. The privacy policy informs individuals; displaying it does not amend an existing contract.
The User accepts the Terms through a positive action at their first access and whenever a change requires a new acceptance. The accepted version and the date are kept as evidence. This acceptance is neither consent to the recording of a meeting nor a general consent to the processing of all data. The commercial clauses place no payment obligation on the invited User.
3. Service offered
La Mashine supports entrepreneurial projects: diagnosis, action plan, progress tracking, preparation of deliverables, exchanges with coaches and experts, video calls and meeting notes. The functions actually provided and the support services are those agreed with the Organization.
The entire platform, including its servers, database, files and backups, is hosted by OVH in France. The AI services are separate from this hosting.
Two configurations are offered. The default configuration uses Anthropic in the United States for assistance and content generation. At the documented request of the Organization, the La Mashine team activates a European configuration covering all AI functions, including assistance, diagnosis, drafts, analysis of attachments and meeting notes. In this configuration, the GLM-5.3 model is run by Mistral in the European Union. Mistral also provides audio transcription in the EU.
If the main provider is unavailable before the response has started, a single fallback route may be used: for the EU configuration, GLM-5.3 run by TensorX in Ireland via Requesty EU; for the Anthropic configuration, Claude run on Google Vertex in the EU via Requesty EU. Each fallback uses a specific deployment, with no substitution of host. If this fallback fails, the request fails with an understandable message. The EU configuration never falls back to Anthropic or to AI processing outside the EU. The Anthropic configuration remains a configuration involving processing in the United States, even though its fallback is European.
The providers, places of processing and retention periods are set out in the privacy policy and the applicable DPA. The request to activate the EU mode and its effective date are documented; it has no retroactive effect.
Artificial intelligence outputs are proposals to be reviewed. They may contain errors, omissions or inaccurate references. The User checks the relevant information, sources and rights before any dissemination or decision. The platform guarantees neither the success of a project nor obtaining funding. Generated content does not replace appropriate professional advice.
Within the scope of this offer, recommendations and scores relate to projects. They must not be used to automatically grade a user, validate a course of study, decide on an admission or take an individual educational decision about users. The Organization retains its supervisory responsibilities and its responsibility for human decision-making.
4. Accounts and permissions
Each account is personal. The User provides accurate information, protects their credentials, does not share them and promptly reports any suspicious access to contact@lamashine.com. The Organization appoints its administrators and keeps the list of authorized persons up to date.
Members access their project; coaches the projects assigned to them; administrators the projects of their organization; experts the context needed for their intervention. Meeting notes follow these permissions. Full transcripts and audio recordings cannot be viewed in the interface. Any access to them under statutory rights is handled separately, while protecting the rights of third parties.
Workspaces are not public and do not allow access across institutions. Authorized La Mashine staff may access the elements needed for support, maintenance or security, within the limits of their duties and their confidentiality obligations.
5. Content and permitted uses
The User only uploads content that they are authorized to use and to share with authorized persons. They respect the confidentiality, copyright, trade secrets and personal data of third parties. The Organization ensures the lawfulness of the processing it determines, the information of the persons concerned and, where necessary, the collection of their consent.
It is forbidden to import special categories of data within the meaning of Article 9 of the GDPR, data relating to criminal convictions and offences, identity documents, passwords or authentication secrets, and unlawful content. The User limits data about contacts, prospects and interviewees to what the project needs. Consent is not presented as the only possible legal basis for every contact detail.
It is forbidden to impersonate someone, to harass a person, to bypass permissions, to seek unauthorized access, to introduce malware or to disrupt the platform. Security testing requires prior agreement. Web search functions must not receive personal data or identifying confidential content.
An upload error or problematic content can be reported to contact@lamashine.com. La Mashine takes the necessary proportionate measures and cooperates with the Organization to correct, restrict or delete the elements concerned.
Content sent to the platform must not include data about minors, official identifiers issued by a public authority or payment card data. In the event of an accidental upload, it should be reported without delay so that it can be restricted and deleted.
6. Meetings and meeting notes
Audio recording is optional and is used solely to produce a technical transcript and then the project’s meeting notes. Mistral provides the transcription in the EU; the meeting notes are produced according to the Organization’s AI configuration and its authorized route, described in Article 3. No video, shared screen image or video-call chat is recorded by this function.
Before the recording, each participant receives information on its purpose, the providers, the recipients and the retention periods. They personally give their agreement for the session. The organizer cannot consent on their behalf. The agreement is time-stamped and results neither from silence nor from acceptance of the Terms. A saved preference does not exempt the participant from personal validation for the session.
A refusal prevents the recording from starting: no audio is then recorded, transcribed or sent to the AI under this function. Any newcomer must validate before being included in a recording; otherwise, the recording is paused. A refusal does not close access to the rest of the platform.
The participant may withdraw their agreement at any time. If they withdraw it during a recorded session, they leave that session; capture of their audio stops immediately. They may report their withdrawal to the organizer and to contact@lamashine.com, in particular for the handling of data already collected. Withdrawal does not affect the lawfulness of earlier operations; data based solely on this consent is erased when the legal conditions so require. The rights of the other participants are also taken into account.
The Organization must allow an unrecorded exchange or an equivalent means of contribution when a refusal or withdrawal would prevent the person from benefiting from the support. A refusal or withdrawal cannot lead to a sanction or an adverse educational consequence.
The audio is deleted when the meeting notes are signed and, in any event, no later than thirty days after the session. Meeting notes must be reviewed before validation; they may contain transcription or summary errors. The non-viewable technical transcript and the meeting notes follow the duration of the project, subject to erasure rights and the Organization’s instructions.
7. Ownership and confidentiality
La Mashine acquires no ownership rights over projects and their content. Founders, authors and other right holders retain their respective rights, subject to the rights of third parties. La Mashine undertakes not to transfer, copy or reuse the content of one project for the benefit of another project, including within the same organization, nor to use it as context to generate AI responses intended for another project. Permissions allowing several projects to be viewed do not authorize La Mashine to pool their content. This restriction does not prevent the program monitoring indicators expressly provided for in the contract.
Educational content remains the property of its right holders, in particular the institution. Authors retain their rights to their work. La Mashine retains its rights to its platform, its software, its documentation and its original elements. No general transfer of ownership results from the use of the service.
The User and the Organization grant La Mashine only the reproduction, processing, technical adaptation and provision rights needed to perform the service, for its duration and the authorized retention periods. This authorization allows neither the commercial publication of projects nor their use to train models. Any rights attached to an AI output depend on the applicable law; La Mashine does not guarantee its exclusivity or its protection by copyright.
Authorized recipients respect the confidentiality of the content. Any publication of a project, a testimonial or an image of a person requires the appropriate authorizations. The rights to cite an organization and use its logo, where provided for by a specific contract, do not authorize the disclosure of individual data or confidential projects.
8. Availability and support
The fallback route aims to improve the continuity of the AI functions. It is neither a guarantee of a response to every request nor a guaranteed maximum delay; the same model may produce different responses from one call to another.
La Mashine aims for continuous availability of the service and a first response to support requests within forty-eight calendar hours. These objectives are neither a quantified availability guarantee nor a guaranteed resolution time. Specific commitments, in particular priority support or on-call coverage for a program, remain applicable.
Interruptions may be necessary for security, maintenance or an infrastructure change. La Mashine informs the Organization in advance where reasonably possible, limits the duration of interruptions and handles incidents diligently. It informs without delay of difficulties likely to affect a contractual schedule. The support objectives do not replace the specific deadlines of the DPA.
9. Price and term for the Organization
Prices, numbers of participants, deliverables, deadlines and invoicing terms are set in the Special Conditions. The contract is entered into for their duration, without tacit renewal. Any renewal or additional service requires written agreement. The invited User does not, by merely accepting the Terms, take out a paid subscription.
Unless a specific or mandatory provision provides otherwise, the Organization has no right of early termination for convenience during the fixed term. Remedies for non-performance, force majeure and the rules applicable to public procurement contracts are in particular reserved. Penalties and payment terms are those legally applicable and agreed with the Organization.
10. Suspension and end of access
La Mashine may restrict access to the extent necessary to address a security risk, unlawful content, misuse of the service or a breach of these terms. Except in an emergency or where legally prohibited, it informs the person or the Organization, states the reason and allows them to remedy the problem. A measure must not exceed what is necessary. The consequences of non-performance of the main contract follow that contract and the applicable law.
The Organization may withdraw its users’ permissions. The end of the program or of the contract ends the corresponding rights of use, without prejudice to limited access organized for the return of data. Keeping a file does not give an independent right to continue using the service.
The Organization may request an export of its text data in JSON format and the separate delivery of the associated files in their original format. Deleting an account does not necessarily delete all of the project’s contributions: what happens to these contributions depends on the applicable rights and the Organization’s instructions. Replacing a name is not, on its own, enough to guarantee anonymization. The privacy policy and the DPA set out the terms and retention periods.
11. Liability
Each party is liable for the breaches attributable to it under the conditions of the applicable law. La Mashine is bound by the diligence expected of a professional service provider and by the commitments it has expressly made; it does not guarantee the accuracy of every AI response, the success of a project or the complete absence of any interruption.
The Organization remains responsible for the purposes it determines, its permissions and the decisions it takes. The User remains responsible for their own uses and the content they send, without this releasing La Mashine from its obligations. These terms remove no mandatory right, no liability that cannot be excluded, nor the rights of individuals under the GDPR.
12. Changes and disputes
La Mashine informs users of substantial changes to the Terms before they apply and asks for a new acceptance where necessary. An urgent change imposed by law or security may take effect immediately with appropriate information. A publication does not unilaterally amend Special Conditions or a DPA already accepted.
The parties seek an amicable solution by writing to contact@lamashine.com. These terms are governed by French law, subject to applicable mandatory provisions. Failing agreement, the dispute falls within the jurisdiction of the court with subject-matter and territorial competence under ordinary rules, including the rules specific to administrative contracts where they apply.
